1. INTRODUCTION
MALACHITE PRT, UNIPESSOAL LDA" is a Portugal-registered company with Company Number 518038300 rep, operating the festival "Afro Nation Portugal" where tickets, addons, and hospitality services (hereafter referred to as "Product and Services") may be purchased.
The following Booking Conditions set forth the terms and conditions governing the purchase of Tickets and Hospitality from us. Please read them carefully, as they establish all rights and obligations.
2. DEFINITIONS
For the purposes of these Booking Conditions, the following terms are defined as follows:
"Ticket(s)": Refers to primary festival tickets that are exclusively allocated by us and made available for sale directly to purchasers.
"Products and Services": Refers collectively to all items available for purchase through us, including but not limited to festival tickets, add-ons (such as merchandise and wristband credits), and hospitality tables.
"You" and "Your": Refer to the individual named on the booking as the lead booker, as well as all individuals for whom the lead booker makes a booking.
"Us," "We," and "Our": Refer to MALACHITE PRT, UNIPESSOAL LDA, including our employees, agents, and any associated business partners.
These Booking Conditions govern all purchases of Tickets and Hospitality services directly from us. If you are considering or making a purchase, you agree to be bound by the terms herein. Further details on our Products and Services are available on our official website at https://www.afronation.com/.
3. LEGALLY BINDING CONTRACT
Your contract with MALACHITE PRT, UNIPESSOAL LDA ("we," "us," or "our") is established upon confirmation of your order and is fulfilled immediately following the conclusion of the Afro Nation festival for which you have purchased Products and Services.
3.1 Formation of Contract: A binding contract between you, the lead booker, and us is created upon receipt of your payment (either in full or the initial instalment under a payment plan). By making a booking with us, you, the lead booker, expressly agree that:
1. Acknowledgement and Acceptance:
You have read and understand these Booking Conditions and, by entering into this contract, you agree to be bound by them, as does every member of your booking.
2. Booking Fee:
A booking fee of 14% will be applied to all Products and Services as advertised and sold on our website. This fee is separate from the ticket or package price.
3. Payment Responsibility:
You accept full financial responsibility for the total cost of the booking, inclusive of all instalments and any applicable fees, and you agree to complete payments according to the agreed Payment Plan schedule. Failure to adhere to the Payment Plan schedule may result in the cancellation of your booking.
4. Data Consent and Privacy Compliance:
You consent to our use of your personal data, including any special categories of personal data (e.g., health conditions, disabilities, dietary requirements), in accordance with our Privacy Policy, and you confirm that you are authorised to provide this information for all individuals included in the booking.
5. Minimum Age Requirement:
By purchasing Products and Services with any age restrictions, you confirm that you are over 18 years old and that all members of your party meet the appropriate age requirement. Purchases must be made with a valid credit or debit card issued in the lead booker’s name.
6. Use of Likeness:
You consent to the use of your likeness and that of your booking party in any film, photography, audio, and/or audiovisual recording taken by us, for use across any media globally without compensation, for purposes including but not limited to festival promotion, security, and crime prevention. Should you wish to object to this use, you must submit a written notice to hello@afronation.com prior to the festival.
7. Changes to Booking Conditions:
We reserve the right to amend these Booking Conditions as deemed necessary. You are advised to review them regularly to ensure awareness of any changes. Your continued purchase and acceptance of our Products and Services signifies your agreement with the terms in effect at the time of purchase. If you do not agree to any revised terms, you must refrain from making further purchases.
3.2 Applicable Terms:
All purchases are governed by the version of these Booking Conditions that is in effect at the time of purchase. If you disagree with or cannot comply with any changes to these terms, you agree not to purchase Products and Services from us.
4. PRODUCT AND SERVICES
Our offerings consist of various types of tickets, clearly identified and defined at the point of purchase via Afro Nation, as well as additional addons and hospitality tables that may be purchased separately for an additional cost.
4.1 Non-Refundable Sales
By completing any purchase, you acknowledge and accept that all Products and Services, including tickets, addons, and hospitality tables, are non-refundable and non-exchangeable. However, if you have purchased booking protection through XCover.com, you may be eligible for a refund under the terms and conditions of XCover.com Protection. In such cases, you must file a successful claim directly with XCover.com in accordance with their policies.
4.2 Currency and Payment Processing
All prices are listed and charged in the specified currency. We disclaim any responsibility or liability for supplementary fees imposed by your payment provider or for any currency exchange rate fluctuations, which remain entirely at your risk and responsibility.
4.3 Scope of Offerings
Please be advised that we do not offer any packages, travel, or flight bookings. Accordingly, we accept no liability for issues arising from flight or travel arrangements made independently in connection with the festival.
4.4 Right to Amend Prices and Correct Errors
We reserve the right to amend any advertised prices at our discretion and to correct errors in advertised and confirmed prices. Prices are not guaranteed until full payment has been received and verified.
4.5 Market-Priced (Dynamic Pricing) Tickets
Certain tickets may be subject to market pricing, whereby ticket prices may vary based on demand, similar to airline and hotel pricing. Known as "Dynamic Pricing," this pricing approach means that ticket prices may increase or decrease at any time before purchase. You will not be entitled to any refund, credit, or adjustment if:
The price of the ticket you purchased was, at any time prior to your purchase, lower than the price you paid; or
Any tickets to the same festival (whether in the same price category or otherwise) are reduced after your purchase.
4.6 Order Confirmation and Purchase Verification
If you do not receive an order confirmation following submission of your payment information, or if you encounter any error message or interruption in service during this process, it is your responsibility to confirm with us whether your order has been completed. We are not liable for any costs or losses incurred if you incorrectly assume an order was or was not placed due to the absence of order confirmation.
4.7 Credit and Debit Card Verification
All purchases are subject to verification procedures, including but not limited to credit or debit card validation, security checks, and payment collection by us. We reserve the right to cancel any order that fails to pass our verification process or where full payment has not been received. In rare instances where a payment is recalled by the issuing bank or payment provider, we may cancel and refund the order, irrespective of any order confirmation issued. We disclaim any responsibility or liability for such cancellations, as they are outside our control.
4.8 Prohibition on Automated Purchasing and Fraudulent Activities
Purchasing or attempting to purchase Products and Services through the unauthorised use of automated devices, software, or processes—such as bots, spiders, or unauthorised linking or framing—is strictly prohibited. We reserve the right to cancel any orders reasonably suspected to have been placed in violation of these Booking Conditions, without notice to you, rendering all associated Products and Services void.
4.9 Anti-Fraud Measures
In our commitment to fraud prevention and protection, we may conduct checks and/or request additional information to verify purchases. We reserve the right to cancel any orders reasonably suspected of being fraudulent, without notice to you, and any Products and Services obtained through such orders will be rendered void.
4.10 Responsibility to Verify Prices
It is your responsibility to confirm the accuracy of the price of your selected Products and Services at the time of booking, as prices may vary, and errors may occasionally occur.
5. DISPUTES AND CHARGEBACKS
5.1 General Provision on Disputes and Chargebacks
Except where exercising rights under section 75 of the Consumer Credit Act 1974 or other statutory rights that cannot be excluded, you agree not to initiate a dispute or chargeback with your card issuer or financial institution regarding any transaction with us.
5.2 Default or Modification of Payment Plan
If you default on, unilaterally amend, or agree to cancel any agreed payment plan or booking, as defined in Clause 12, you agree not to initiate any dispute or chargeback in relation to such transactions, except as permitted by statutory consumer protection laws.
5.3 Third-Party Booking Protection
If you purchase booking protection through XCover.com at checkout and any claims under that policy are denied, or, you do not attempt to make a claim, you agree not to initiate a dispute or chargeback with your bank in relation to the original booking transaction with us. Any claims regarding the booking protection product must be pursued directly with XCover.com, as we hold no liability for their decision.
5.4 Refunds and Claims
Your rights to refunds, claims, or other remedies shall be governed by these Booking Conditions in addition to any statutory rights that cannot be excluded under applicable consumer law.
5.5 Chargeback Defence
In the event of any improper or unjustified chargeback attempt, we reserve the right to present this Clause as evidence to defend against the chargeback with your financial institution.
6. VOUCHERS AND TICKETS
6.1 Dispatch of Tickets and Vouchers
Tickets and/or vouchers will be dispatched as soon as reasonably practicable, but not before full payment has been received. While we will endeavour to provide an estimated delivery timeframe, we cannot guarantee specific delivery dates.
6.2 Failure to Receive Tickets or Vouchers
If you have not received your tickets or vouchers at least 5 days before the event (or, if earlier, 5 days before your departure for the event), you must notify us immediately at hello@afronation.com.
6.3 Delivery Responsibility
You are solely responsible for providing a valid email address for the electronic delivery of your tickets. You must ensure that your email account is capable of receiving such delivery (including ensuring your email provider does not reject, bounce, or block emails from us, and by checking all folders, including spam and junk). We shall not be liable for any failure to deliver tickets if the failure is caused by you providing incorrect or incomplete contact information, or failing to check your email inbox.
6.4 Collection of Tickets
In certain circumstances, we reserve the right to require you to collect your tickets at the event venue’s box office or an alternative designated collection point. We will notify you in advance of any changes to the delivery method. You may be required to provide your booking confirmation email, photo identification, and the credit or debit card used for the booking in order to collect your tickets.
6.5 Verification of Tickets
It is your responsibility to check your tickets immediately upon receipt. Any discrepancies or errors must be reported to us at hello@afronation.com without undue delay and, in any event, within 5 days of receipt, or prior to the event if that is sooner. We cannot guarantee that errors will be corrected if not notified promptly.
6.6 Ticket Ownership and Licence
Tickets purchased from us remain the property of MALACHITE PRT, UNIPESSOAL LDA at all times and are issued as a personal, revocable licence. We reserve the right to withdraw this licence and refuse admission to the event at any time.
6.7 Lost, Stolen, or Damaged Tickets
You acknowledge that lost, stolen, damaged, or destroyed tickets may not be replaced. However, if replacement tickets are issued, we may charge a reasonable administration fee.
6.8 Purchase Restrictions
Ticket purchases may be subject to limits per person, per credit or debit card, or per household. We reserve the right to cancel orders where these limits have been exceeded, without prior notice.
6.9 Prohibition on Resale and Commercial Use
You are prohibited from purchasing tickets with the intention of reselling them for profit unless formal written permission has been obtained from us. If we discover or suspect that tickets have been purchased for resale in violation of this condition, we reserve the right to cancel the tickets without notice.
6.10 Use of Tickets
Tickets purchased from us may not be used for any of the following purposes without our express written consent:
Advertising, promotions, contests, sweepstakes, or other commercial purposes;
Combining tickets with hospitality, travel, accommodation, or any other product or service to create a package for resale or distribution.
Any use of our intellectual property, including trademarks, for the above purposes will require our explicit prior written approval.
6.11 Complimentary Tickets
Complimentary tickets hold no face value and are not subject to any refund or compensation in the event of cancellation or complaints regarding the event. No cash alternative will be offered for complimentary tickets.
7. ACCESSIBLE TICKETS
7.1 Agreement to Terms
By purchasing an accessible ticket, you acknowledge and agree to comply with these terms and conditions, as well as any other relevant policies set forth by Afro Nation Portugal.
7.2 Access to Accessible Facilities
Purchasing an accessible ticket grants you access to the designated accessible facilities at the Afro Nation event within your chosen ticket tier, subject to availability and in accordance with our accessibility policies.
7.3 Access Card Requirement
All customers requiring accessibility accommodations are required to apply for and obtain an Access Card prior to purchasing an accessible ticket. The Access Card application must be approved and issued by Afro Nation or the relevant authority before any accessible ticket can be purchased.
7.4 Companion Ticket
Access Card holders displaying the +1 symbol are entitled to receive a complimentary companion ticket. This ticket allows one companion to accompany the Access Card holder in the same ticket area. The companion must remain with the Access Card holder for the duration of the event and is fully responsible for the Access Card holder's welfare. Availability of complimentary companion tickets may vary depending on the specific event or venue and is subject to limitations.
7.5 Accessible Viewing Platform
The Accessible Viewing Platform is reserved for individuals using wheelchairs, those with significant mobility impairments, and their designated companions. To access this platform, customers must contact hello@afronation.com to request a wristband, which grants access to the designated viewing area.
7.6 Fraud Prevention Measures
Afro Nation Portugal takes the issue of fraudulent claims seriously and has implemented measures to protect the integrity of the accessible ticketing system. Customers are not required to provide proof of eligibility (such as medical documentation) directly to us. Instead, eligibility is confirmed by successful application and approval for the Access Card Scheme, which must be presented at the event.
7.7 Commitment to Accessibility
We are committed to ensuring that all festival attendees, including those requiring accessibility accommodations, have an enjoyable and seamless experience. We strive to provide an inclusive environment for everyone attending Afro Nation.

If you require special assistance or have any questions regarding accessible facilities, please contact us at hello@afronation.com. We are happy to assist with any specific requirements you may have to ensure your comfort and safety during the event.
8. HOSPITALITY
8.1 Package and Festival Entry
Premium Upgrade Packages
Booking a table does not grant access to the festival grounds. Our General Admission, VIP, or Golden festival ticket must be purchased in addition to the hospitality package.
8.2 Non-Refundable Bookings
All table bookings are non-refundable, and therefore, no refund requests can be accommodated.
8.3 Wristband Collection
The lead booker and all members in their group must be present during the wristband collection process. We cannot give wristbands to those not present.
8.4 Refund and Chargeback Policy
By purchasing a table, customers agree not to claim a refund or request a reduction in the price of the hospitality table. Customers are also aware of this policy and agree not to submit any chargebacks, as stated in clause 5 ('DISPUTES & CHARGEBACKS').
8.5 Entry and Refusal Rights
Table bookings do not guarantee entry; intoxicated guests may be refused entry, and management reserves the right to refuse admission. All guests must be over 18 years old and must present a valid passport or driving license as ID. Table reservations must arrive before 7 pm.
Bespoke Upgrade Packages
8.6 Bespoke Upgrade Packages - Festival Day Access
Bespoke package guests will be issued with a festival day access wristband that grants them access to their table and the festival exclusively for the correlating day of booking. These wristbands will become invalid on days not correlating to the day of booking and access to the festival will be denied during these days.
8.7 Bespoke Upgrade Packages - Multiple-Day
If a bespoke package has been purchased for multiple days of the festival, guests will receive a separate wristband for each day.
8.8 Access to VIP and Golden Areas
If you have purchased a GENERAL ADMISSION ticket, booking a hospitality table grants access to the GOLDEN and VIP areas for the selected day only. Access to these areas on other days requires separate hospitality table bookings.
8.9 No Refunds on VIP or Golden Tickets
Customers who have already purchased a VIP or Golden ticket are not entitled to refunds on festival tickets or reductions in price for hospitality tables.
8.10 Wristband Collection for Bespoke Packages
The lead booker and all members in their group must be present during the wristband collection process. We cannot give wristbands to those not present.
8.11 Refund and Chargeback Policy for Bespoke Packages
By purchasing a table, customers agree not to claim a refund or request a reduction in the price of the hospitality table. Customers are also aware of this policy and agree not to submit any chargebacks, as stated in clause 5 ('DISPUTES & CHARGEBACKS').
8.12 Refusal of Entry for Bespoke Package Holders
Table bookings do not guarantee entry; intoxicated guests may be refused entry, and management reserves the right to refuse admission. All guests must be over 18 years old and must present a valid passport or driving license as ID. Table reservations must arrive before 7 pm.
9. FESTIVAL TIMINGS AND ADMISSIONS
9.1 Changes to Festival Times and Program
Advertised festival start times are subject to change. The opening and closing times of the venue or gates do not indicate the festival’s start or end time, nor do they reflect when artists are scheduled to perform or the duration of their performances. These details are subject to our and/or the artists' discretion and may change without notice.
9.2 Artist Lineup and Program Alterations
We reserve the right to alter the artist lineup, schedule, and/or festival program at our discretion, without any obligation to offer refunds or exchanges. Any such changes will be considered minor or immaterial and will not entitle ticket holders to a refund or compensation.
9.3 Security Searches and Admission Refusal
Security searches may be carried out on patrons at any time, and admission may be refused to individuals who breach, or are suspected of breaching, these Booking Conditions.
9.4 Trading and Unauthorized Goods
Trading or promotional activities within the festival site are not permitted without our prior written consent. Any goods bearing unauthorized logos or trademarks must be surrendered to festival staff upon request.
9.5 Admission and Venue Terms
Admission to the festival is subject to the terms and conditions of the relevant venue. Certain items (e.g., laser pens, mobile phones, pets, and food and drink brought by patrons) may be prohibited on the site. Unauthorized use of photographic or recording equipment is prohibited; any such materials may be confiscated, destroyed, or deleted. The use of drones or similar devices near the festival site is strictly prohibited.
9.6 Health and Safety
Patrons who believe they may have been infected with Covid-19 or are displaying symptoms of Covid-19 must not attempt to enter the festival site. If you are displaying symptoms or suspect exposure, please follow public health guidance and refrain from attending.
9.7 Refusal of Admission and Removal from Venue
We or the venue reserve the right to refuse admission or remove any person from the venue if they pose a risk to public safety, engage in unacceptable behavior, or breach these Booking Conditions. In such cases, no reimbursement or refund will be provided.
9.8 Pass-Outs and Re-admissions
Unless expressly authorized in advance, pass-outs and re-admissions are not permitted during the festival.
9.9 Health and Safety Risks
Patrons are advised that prolonged exposure to loud music or noise may cause hearing damage. We strongly recommend ear protection. Special effects, such as pyrotechnics, lighting, and audio-visual effects, may not be suitable for individuals with photosensitive epilepsy or similar medical conditions.
9.10 Queuing and Entry
Ticket holders should expect queues at entry gates and are advised to arrive in time for the first act they wish to see. We will not provide refunds for acts missed due to late arrival or delays at the entrance.
10. EVENTS BEYOND OUR CONTROL (FORCE MAJEURE)
10.1 Definition of Force Majeure
We will not be held liable or obligated to provide compensation for any failure to perform or delay in performing our contractual obligations where such failure or delay is caused by Force Majeure. For the purposes of these terms, "Force Majeure" refers to any event or circumstance beyond our reasonable control, which could not have been avoided with reasonable care or foresight. Such events include, but are not limited to:
War, acts of terrorism or the threat thereof, civil unrest, or acts of government or authority;
Significant health risks or disease outbreaks, including pandemics (e.g., COVID-19 or similar events);
Natural disasters (e.g., floods, earthquakes, severe weather conditions);
Industrial disputes, strikes, lockouts, or any form of labor disruption;
Acts of God, such as fires, chemical or biological disasters, and nuclear accidents;
Unforeseeable technical problems with transport or infrastructure.
10.2 Impact of Force Majeure on Festival
If the festival is cancelled, postponed, or affected in any way due to a Force Majeure event, we shall not be liable for any losses, damages, or costs incurred by you as a result. This includes, without limitation, travel expenses, accommodation, or any other associated costs.
10.3 Travel Restrictions and Entry Denials
It is your responsibility to ensure that you can legally enter the country where the festival is held (Portugal). If you purchase a ticket and are subsequently denied entry due to governmental restrictions or regulations (e.g., visa issues, travel restrictions, border closures), this will be treated as a Force Majeure event, and no refund will be provided.
10.4 No Refunds Due to External Factors
No refund, exchange, or compensation will be provided if your ability to attend the festival is affected by factors outside of our control, including but not limited to:
Travel restrictions imposed by your country of origin or the host country (Portugal);
Quarantine requirements, vaccination mandates, or similar public health measures;
Any other government-imposed restrictions that prevent your attendance.
11. CANCELLATIONS
11.1 Cancellation by Us
In the unfortunate event that we are required to cancel the entirety of the festival, we will provide written notification of the cancellation. However, we do not accept liability for any losses or expenses incurred by you as a result of the cancellation, including but not limited to travel, accommodation, or any other associated costs.
Please note that any fees paid in relation to amendments, bookings, or related services are non-refundable under any circumstances, including in the event of a festival cancellation.
11.2 Cancellation by You
If you fail to meet the payment obligations under your agreed payment plan despite our reasonable attempts (up to three attempts) to process the payment, we reserve the right to cancel your booking. In such cases, you will not be entitled to any refund.
Additionally, should you voluntarily cancel your booking, whether it be for a payment plan or a fully paid booking, you acknowledge and agree that all payments made are non-refundable. Our products and services are sold on a non-refundable basis, and we will not accept any refund requests under any circumstances. Please ensure you are fully satisfied with these terms before making your purchase.
12. TRANSFERS
12.1 No Transfer of Bookings
Bookings are strictly non-transferable. Once a booking has been made, it cannot be transferred to another individual or changed to a different date, event, or service.
13. NAME CHANGES
13.1 Introduction
A non-refundable name change fee of €25 applies for any request to amend the name on a ticket within a booking.
13.2 Applicability
The name change fee applies to the lead booker who wishes to transfer the ticket to another individual by updating the name on the ticket. Only one name change is allowed per ticket within a single booking.
13.3 Fee Amount
The fee for changing the name on a ticket is €25 per ticket. This fee is non-negotiable and non-refundable.
13.4 Process
To initiate a name change, the lead booker must contact Afro Nation Customer Support before June 14th, 2025. The request must include the original ticket holder's details, along with the new ticket holder’s full name, date of birth, telephone number, gender, nationality, and country of residence. Once payment is completed, our team will process the change.
13.5 Payment
The name change fee must be paid in full before the ticket details can be updated.
13.6 Deadline
All name change requests must be submitted and processed prior to June 14th, 2025. Requests submitted after this date will not be considered.
13.7 Transferability
The name change fee applies per ticket and is non-transferable between ticket holders. Only the lead booker will be contacted regarding amendments to a booking.
13.8 Verification
Afro Nation Portugal reserves the right to verify the identity of both the original and new ticket holder before processing any name change. Failure to provide satisfactory identification may result in the refusal of the name change request.
13.9 Payment Plan Completion
All payments under any payment plan must be completed before submitting a name change request. If the customer wishes to pay off the balance early to facilitate a name change, they should contact us at hello@afronation.com.
13.10 Limitations
The payment of the name change fee does not guarantee approval of the request. Afro Nation Portugal reserves the right to reject any name change request at its discretion.
13.11 No Refunds
The name change fee is non-refundable under any circumstances.
13.12 Final Decision
All decisions regarding name change requests, including approval, denial, and eligibility, are at the sole discretion of Afro Nation Portugal and are final.
13.13 Modification of Terms
Afro Nation Portugal reserves the right to modify or update these terms and conditions at any time without prior notice. The lead booker is responsible for reviewing the most current terms and conditions before submitting a name change request.
13.14 Acceptance
By requesting a name change and paying the associated fee, the lead booker agrees to be bound by these terms and conditions.
14. POSTPONEMENT
14.1 Jurisdiction and Applicable Laws
Your ticket is subject to the laws and regulations of the jurisdiction in which the festival is held, not the jurisdiction where the ticket was purchased. Any changes to laws or regulations enacted by the governing authority of the festival location will take precedence.
14.2 Event Postponement
In the unlikely event that the festival cannot proceed as originally planned, it will be automatically postponed. You will be entitled to a ticket of equivalent value for the rescheduled festival.
14.3 Notification of Rescheduled Date
We will provide you with the new dates for the rescheduled festival as soon as reasonably possible after they have been confirmed.
14.4 Inability to Attend Rescheduled Festival
If you are unable to attend the rescheduled festival, you must notify us in writing within 30 days from the announcement of the new dates. Upon receipt of your written notice, we will inform you of the available options, which may include the ability to transfer your ticket or receive a refund, depending on the circumstances.
14.5 Failure to Respond
If we do not receive your written confirmation within 30 days of the announcement of the rescheduled festival, you will be deemed to have accepted the alternative ticket provided for the rescheduled event.
14.6 Special Note
We cannot be held liable for any expenses, losses, or inconveniences you may incur as a result of the postponement of the festival.
15.WARRANTIES AND INDEMNITIES
15.1 Representation and Warranty
You represent and warrant that all information you provide to us in relation to your account, as well as in your use of our Products and Services, is true, accurate, and complete. You agree not to provide any false or misleading information, including but not limited to contact details.
15.2 Compliance with Laws
You represent and warrant that, in using our website and accessing or purchasing our Products and Services, you will comply with all applicable laws and regulations. You also agree to adhere to these Booking Conditions, as well as any other applicable terms and conditions that may govern your use of our services.
15.3 Indemnity
You agree to indemnify and hold harmless us and our affiliates, including their respective officers, directors, employees, and agents (the “Indemnified Parties”), from and against any losses, damages, expenses (including reasonable legal fees), liabilities, claims, and demands suffered by any of the Indemnified Parties arising out of or in connection with:
Your breach of these Booking Conditions or any other applicable terms and conditions;
Your violation of any applicable laws or regulations;
Your infringement of any third-party rights.
16. LIMITATION OF LIABILITY
16.1 General Limitation
To the fullest extent permitted by law, we, including our affiliates, parent companies, subsidiaries, and their respective officers, directors, employees, agents, legal representatives, and subcontractors, as well as our relevant suppliers, shall not be liable for any loss, injury, or damage to any person (including you) or property, however caused, in any of the following circumstances:
(a) Where there is no breach of contract or legal duty of care owed by us or our suppliers;
(b) Where such loss or damage is not a direct consequence of any breach on our part or that of our suppliers (excluding death or personal injury caused by our negligence); or
(c) To the extent that any increase in loss or damage results from your own negligence, or breach by you of any of the terms of these Booking Conditions, any other applicable terms and conditions, or any applicable laws or regulations.
16.2 Internet Connection Disclaimer
We accept no liability for any internet connectivity issues that may occur while you use our Products and Services.
16.3 Non-Excludable Liability
Nothing in these Booking Conditions is intended to exclude or limit our liability, or that of any supplier, for death or personal injury resulting from our or their negligence, nor for fraud or any other liability which cannot by law be excluded or limited.
17. QUERIES, COMPLAINTS & DISPUTE RESOLUTION
17.1 Contact Details and Communication
If we need to reach you for updates regarding your booking or marketing information related to Afro Nation Portugal, we will use the contact information you provided when booking. It is your responsibility to promptly notify us of any changes to these contact details, both prior to and after receiving our Product and Services. You must provide a valid email address, as this is our primary method of contact. Please note that email settings may treat our communications as junk; therefore, we advise you to regularly check your junk or spam folders.
17.2 Complaints During the Event
If you encounter any issues during the event that cannot be resolved by on-site staff, and you wish to raise a formal complaint, you must submit a written notice to us at hello@afronation.com within 28 days of the event’s conclusion. Your notice should include your booking reference and any other pertinent information. Conciseness is appreciated as it helps us identify and address your concerns more efficiently. Failure to follow this process may hinder our ability to investigate your complaint and could impact your rights under this contract. 17.3 Organiser Information
The Afro Nation Portugal festival is organised by Malachite Prt, Unipessoal Lda., registered under Company number 518038300.
17.4 Requirement to Contact Us Before Filing a Dispute
By completing a purchase with us, you agree to contact us directly at hello@afronation.com for any queries or complaints regarding your purchase or experience at the event before initiating a dispute with your bank.
18. LAW AND JURISDICTION
18.1 Governing Law
These Booking Conditions are governed by and shall be construed in accordance with Portuguese law.
18.2 Jurisdiction
Both parties agree to submit to the non-exclusive jurisdiction of Portuguese courts for any disputes arising out of or connected to these Booking Conditions.
18.3 Severability of Provisions
If any provision within these Booking Conditions becomes illegal, invalid, or unenforceable under the law of any applicable jurisdiction, this shall not impact the legality, validity, or enforceability of any other provisions in that jurisdiction.
18.4 Enforceability of Remaining Provisions
If a competent court deems any provision of these Booking Conditions invalid or unenforceable, that specific provision shall be omitted, and the remaining provisions shall remain in full force and effect independently.
18.5 No Waiver of Rights
Our delay or failure to enforce any provision of these Booking Conditions does not constitute a waiver of our right to enforce that provision in the future.
19. XCOVER TERMS & CONDITIONS
19.1 Introduction
By purchasing XCover.com Protection through our platform, you agree to these terms in addition to our general Booking Conditions. This protection is provided by XCover.com and is subject to their terms and conditions. For full details, please review XCover.com’s policy prior to booking.
19.2 Coverage
XCover.com Protection provides coverage for the purchase of tickets and associated event purchases (e.g., parking, locker rentals) in case you or another ticket holder cannot attend the event due to the following circumstances:
Injury, illness, or death affecting you, another ticket holder, or an immediate family member (provided the condition was not pre-existing at the time of purchase).
Requirement as a carer for another ill or injured ticket holder.
Unexpected delays due to transit strikes occurring after your booking.
Pregnancy-related medical issues preventing attendance.
Unexpected deployment as a member of the armed forces.
19.3 Exclusions
You are not eligible for protection if:
You are unwilling to attend the event.
You had a pre-existing medical condition affecting your ability to attend the event at the time of purchase.
You fail to provide the necessary documents requested by the XCover.com claims team.
19.4 Claims Process
To submit a claim for XCover.com Protection, you must visit xcover.com/claim within 15 days of the event. You will be required to provide a detailed description of the reason for the claim along with supporting evidence.
19.5 Refunds and Claims
We cannot offer refunds for tickets if XCover.com Protection was not purchased or if your claim under XCover.com Protection is denied. Any claims must be pursued directly with XCover.com.
19.6 Disputes Regarding Claim Refusal
You agree not to initiate a dispute against Afro Nation Portugal if your claim under XCover.com Protection is denied. Any dispute must be handled directly with XCover.com.
19.7 Statement of Demands and Needs
Before purchasing XCover.com Protection, you should assess whether the coverage meets your specific demands and needs. We do not provide advice regarding the suitability of the policy.
19.8 What is Not Insured
Please refer to the XCover.com policy for full details of exclusions. Certain circumstances are not covered, and these will be outlined within the terms provided by XCover.com.
19.9 Fraudulent Claims
Making fraudulent claims under XCover.com Protection will result in the denial of the claim and could lead to termination of the protection.
19.10 Cancellation of Policy
If you wish to cancel your XCover.com Protection, you may do so within 14 days from the date of payment. Please visit xcover.com/help for further details.
19.11 Data Protection
Your personal data will be handled according to XCover.com’s privacy policy, which governs the collection, storage, and use of your information.
19.12 Financial Services Compensation Scheme (FSCS)
XCover.com Protection is covered under the Financial Services Compensation Scheme (FSCS). This may provide protection if XCover.com is unable to meet its obligations.
19.13 Third-Party Rights
Only you and the policy issuer (XCover.com) are parties to the protection contract. No third parties have rights to enforce any terms of this protection.
20. CASHLESS TERMS & CONDITIONS
20.1 Payment Method
The festival utilises a Cashless system for all transactions, powered by Idasfest. By using the Cashless system, you agree to these terms and conditions.
A Cashless wristband will be issued at check-in upon ticket validation.
Activating the wristband requires a fee of €2.50 on the first top-up.
Festival organizers are not responsible for the loss or damage of Cashless wristbands.
Each wristband features a unique QR code, and an 8-character alphanumeric ID printed on the back of the chip.
Track transactions or top up online during the event by scanning the QR code on your wristband.
20.2 Wristband Credit Pre-Purchase
Exclusive Benefits:
Pre-purchase wristband credit vouchers to access exclusive discounts and free credits.
Free credits are available only with pre-purchased packages and must be used after all paid credits.
Key Details:
Free credits are non-refundable and non-transferable.
Packages with free credits and special offers have limited availability.
The amount of credit pre-purchased determines the additional benefits and tokens received.
Redemption:
Download your wristband credit package QR code from your email, if applicable, before arriving.
Present the QR code at the wristband collection point to apply the credits to your wristband.
20.3 Top-Up Process
Onsite and Online Options:
Top up at designated Top-Up points within the festival venue or the wristband exchange area.
After receiving your wristband, top up online by scanning the QR code on the wristband.
20.4 Payment Methods:
Accepted payment methods include cash, debit cards, and credit cards (VISA, VISA Electron, MasterCard).
Top-Up Limits:
Minimum top-up: €5.
Maximum onsite top-up: €300.
Top-ups must be in multiples of €5.
20.5 Requesting a VAT Invoice
Online Invoice Access:
Scan the QR code on your wristband to access your online wallet profile.
Each purchase will have its own invoice, initially issued as a final consumer receipt.
Adding a VAT Number (NIF):
Use the "Edit" button on individual invoice lines to update your information and include your VAT number (NIF).
This system ensures easy management of transactions and invoices, suitable for both personal and business needs.
20.6 Refunds and Unused Credits
Refund Requests:
Refunds for unused credits can be requested between 00:00 on July 16th 2025 and 11.59 on July 20th 2025.
To request a refund, scan the QR code on your wristband to access your online wallet and complete the refund form.
Key Refund Details:
Refunds require a minimum balance of €10.
A processing fee of €1.50 will be deducted from the refund amount.
Refunds will not be issued for requests made after the specified period.
20.7 Processing Time:
Refunds will be processed after the refund request period ends and may take up to 14 business days to reflect in your account. Processing times vary based on your bank and location.
Additional Considerations:
If you pre-purchased credits but did not attend the event, activation and refund fees may still apply.
21. PACKAGE BOOKINGS (Only relating to House of Koko purchases)
This section applies to all packages sold by House of Koko for Afro Nation Portugal 2025, where we act as the Package Organiser. Please read this section in conjunction with Section A of the Booking Conditions.
21.2 ACCOMMODATION
You will be allocated a Sea View Room at the Oriental Hotel in the Algarve from Tuesday 8 July to Sunday 13 July 2025 (5 nights). Room allocation is handled by the hotel and specific room preferences cannot be guaranteed. Double occupancy only. A valid ID and credit/debit card may be required at check-in for a damage deposit or pre-authorisation, subject to the hotel's terms. Check-in is from 15:00 on 8 July 2025. Check-out is by 11:00 on 13 July 2025. We are not responsible for hotel check-in procedures, after-hours restrictions, or communal damage charges unless directly caused by us. Any changes to your booking made after confirmation may incur charges. The hotel may have security on site. Reports of anti-social behaviour (including excessive noise after 22:00, smoking/vaping in rooms, unregistered guests, or damage) may lead to penalties or removal from the premises without refund. If in our or the hotel’s opinion your behaviour causes or is likely to cause distress, danger, or disruption to others, we reserve the right to terminate your booking with immediate effect and without refund.
21.3 TRANSFERS / SHUTTLES
A Premium Airport Shuttle Service for Two People is included in your package: Accurate arrival and departure flight details and flight number must be provided to ensure service. We are not liable for missed transfers due to incorrect or late information provided by you, or due to delays in arrival at the designated pick-up point. Wait times may be expected. No compensation is offered for delays caused by third-party transport services. Transfer services may refuse entry to intoxicated or disruptive passengers. No refunds will be issued in such cases. We are not responsible for luggage damage, delays, or losses during transport. Standard limits apply: 1 checked bag and 1 carry-on per person.
21.4 BOAT PARTIES
You will be allocated x2 tickets for an Official Afro Nation Boat Party in the Algarve on Wednesday 9th July 2025 at 12:00 – 15:00. Boat Party tickets are non-transferable. No refunds will be issued if you are unable to attend the Boat Party for any reason, including travel delays, illness, or personal circumstances. Boat Parties operate in a variety of weather conditions. In the event of extreme or unsafe weather, the schedule may be delayed, altered, or cancelled at the discretion of the organisers or the vessel operator. No refunds will be given for weather-related delays or changes, unless the event is cancelled in full. The vessel may have security personnel onboard. Anti-social behaviour (including excessive intoxication, harassment, unsafe conduct, or possession of prohibited substances) may result in removal from the Boat Party without refund. We are not responsible for the boat operator’s boarding procedures, onboard rules, or damage charges unless directly caused by us. If in our or the boat operator’s opinion your behaviour causes or is likely to cause distress, danger, or disruption to others, we reserve the right to deny boarding or terminate your participation with immediate effect and without refund.
21.5 POOL PARTIES
You will be allocated x2 tickets for each of the Official Afro Nation Pool Parties in the Algarve at No Solo on Tuesday 8th July 2025 at 12:00 – 22:00 & Saturday 13th July 2025 at 12:00 – 22:00 Pool Party tickets are non-transferable No refunds will be issued if you are unable to attend the Pool Party for any reason, including travel delays, illness, or personal circumstances. Pool Parties operate in a variety of weather conditions. In the event of extreme or unsafe weather, the schedule may be delayed, altered, or cancelled at the discretion of the organisers or the venue. No refunds will be given for weather-related delays or changes, unless the event is cancelled in full. MERCH As part of your package, you will receive two (2) official merchandise items (“Merch”) provided by Afro Nation. You must provide your preferred sizes within the specified time frame, which will be communicated to you in advance. If sizing information is not received by the deadline, we will issue generic sizes at our discretion. No exchanges will be permitted in this case. Merchandise items are pre-selected and cannot be chosen by you. Afro Nation reserves the right to determine the styles, colours, and designs included. Merchandise is non-refundable and non-exchangeable, except in the case of a faulty item, which must be reported within 3 days of collection. Merchandise will be distributed in advance to the hotel. Full details will be communicated ahead of the event. Afro Nation is not responsible for lost, stolen, or damaged merchandise once it has been distributed. Merchandise is for personal use only and may not be resold, rebranded, or reproduced without written permission.
21.6 PRICING OF PACKAGES
Prices are based on current rates and availability. We reserve the right to: Adjust package prices before booking is confirmed. Correct pricing errors at any time. Increase prices after booking if there are changes to: Transportation costs (e.g. fuel prices), Third-party taxes or fees (e.g. hotel taxes), Currency exchange rates.
21.7 CUTTING YOUR EXPERIENCE SHORT
If you return home early or miss any part of your package (e.g., hotel nights, parties, or credits), no refund will be provided. Claims may be made through your travel insurance provider where applicable.
21.8 IF YOU CHANGE YOUR BOOKING
If you wish to make changes after your booking is confirmed, you must email us at [hello@afronation.com] from the lead booker’s address. All changes are subject to availability and may incur a £50 per person admin fee plus any supplier costs. The closer to the travel date the request is made, the higher the potential cost.
Where changes cannot be accommodated, and you choose not to proceed, your booking will be treated as a cancellation. Booking Modifications: Downgrading from a full package to tickets-only or reduced services is not permitted. Upgrades or modifications within the same or higher package tier may be requested, subject to availability and cost. All amendment fees must be paid before changes are confirmed.
21.9 TRANSFER OF BOOKING
If you or a member of your party is unable to attend Afro Nation Portugal 2025, you may request to transfer your package to another individual. Transfers are permitted subject to the following conditions: No profit or resale: You may not resell or transfer the package for profit or as part of any promotional campaign (e.g., competitions, giveaways, or resale above face value). Eligibility: The transferee must meet all conditions of the original booking and be introduced by you. Advance notice: You must notify us no later than 4 weeks before the event start date (by 11th June 2025) at [hello@afronation.com]. Fees: A transfer incurs a £50 administration fee per person, plus any additional costs charged by suppliers. Agreement: The transferee must agree to be bound by our full Terms & Conditions, including the original package contract. Joint liability: You and the transferee remain jointly and severally liable for the full cost of the booking. Important: Package holders are not eligible to downgrade to individual event tickets or use any form of ticket resale platform. If you cannot find a replacement, the cancellation charges listed below will apply. No refunds will be offered for any unused services or non-attending guests. Please note that certain services included in the package may be non-transferable, and changes to these elements may result in a 100% cancellation fee.
21.10 CANCELLATION BY YOU
If you need to cancel your confirmed booking, the lead booker must notify us in writing by emailing [hello@afronation.com]. Cancellation is effective from the date we receive written notice. If one or more guests cancel, this may increase the per-person cost for those remaining. You will be responsible for paying any such increase.
Cancellation Charges
Amendment fees are non-refundable. In some cases, elements of the package are non-cancellable and incur up to 100% cancellation fees regardless of the notice period. You may be able to recover cancellation costs via your travel insurance provider if the reason is covered under your policy.
CANCELLATION DUE TO UNAVOIDABLE & EXTRAORDINARY CIRCUMSTANCES
You may cancel without a cancellation charge if “unavoidable and extraordinary circumstances” significantly affect: the delivery of the event, or your ability to travel safely to Portugal. These must be confirmed by the UK Foreign, Commonwealth & Development Office (FCDO) advising against travel to Portugal or the specific Algarve region. Examples include: natural disasters, serious disease outbreaks, war, terrorism, or life-threatening weather conditions. If your cancellation qualifies under this clause, we will refund all monies paid, but no compensation will be issued.
21.11 IF WE CHANGE OR CANCEL YOUR PACKAGE
As this package is arranged many months in advance, we reserve the right to make changes or cancel bookings when necessary. Minor Changes We will notify you of minor changes but accept no liability for them. These may include: Change to the included merchandise or gift items Adjustment of event schedules or party start times Substitution of a party venue or artist in a multi-artist lineup Hotel room reallocation within the same category (e.g. Sea View)
Significant Changes Examples of significant changes include: Change in hotel area (e.g., away from the Algarve) Downgrade of hotel accommodation Removal of major package components (e.g. parties or transfers) If a significant change or cancellation occurs, we will offer you: A revised package of equal or higher value (if available), or An alternative package of lower value with a refund of the difference, or A full refund of all monies paid (excluding amendments or extras) You must notify us of your decision within 7 days of the revised offer. Failure to respond will be treated as acceptance of the change. We are not obligated to offer compensation in the following cases: Minor changes to the package Cancellation more than 45 days prior to departure Changes requested by you Failure to pay your balance on time Cancellation due to Events Beyond Our Control (e.g. natural disasters, government restrictions) If we are unable to provide a significant portion of your experience after it begins, we will arrange suitable alternatives and refund any price difference where applicable.
21.22 COMPLAINTS
We are committed to ensuring your package experience runs smoothly. If an issue arises:
Please report it immediately to the relevant provider (e.g., hotel front desk). If unresolved, notify our onsite team or email [hello@afronation.com] during the experience. If the problem persists or you are dissatisfied, you must contact our emergency line (included in your travel documents) for urgent support. If your complaint is not resolved locally, please send a written summary to [hello@afronation.com] within 28 days of your return. Include your booking reference and a clear explanation of the issue. Failure to follow this process may reduce or void your right to a refund or compensation.
21.23 OUR RESPONSIBILITY TO YOU (For Package Experiences)
As the organiser under UK law (Package Travel and Linked Travel Arrangements Regulations 2018), we’re responsible for making sure all services in your confirmed package are provided properly. If we or our suppliers don’t meet these responsibilities and you report the issue promptly, and it affects your experience, you may be entitled to a refund, compensation, or both. The amount will depend on the seriousness of the issue and how it affected your enjoyment. You’ll need to show we or our suppliers were at fault. What We’re Not Responsible For: We’re not liable if the issue is due to: Something you or someone in your group did or didn’t do. A third party not involved in providing your package, where the issue was unavoidable and extraordinary. Events Beyond Our Control. Limits on What We’ll Pay: Loss of personal belongings/money: We’ll only pay up to the excess on your insurance policy. You’re expected to have insurance for this. Other issues (not involving injury, illness or death): We’ll pay up to 3x the total cost of your booking—but only if everything went completely wrong. Issues related to travel or hotels: Our responsibility is limited by international laws (like the Paris Convention). You’re also bound by the travel companies' own rules and conditions. If you’re eligible for compensation from an airline (like under EC 261/2004 for flight delays), we won’t pay you more for the same issue. We may deduct any amount you receive from transport providers or hoteliers when paying a claim. Important: We don’t sell flights, so we’re not responsible for flight issues.
To make a claim, follow our complaints process. If we pay compensation, you (or your parent/guardian if under 18) must give us the right to take action against anyone else responsible. What We’re Not Liable For: Anything we couldn’t have predicted based on the information you gave us at the time of booking. Business-related losses. Indirect or knock-on losses. We’re also not responsible for services not included in your package or advertised on our website (like excursions you book yourself or hotel extras). If You’re Stranded Due to Extraordinary Circumstances: If something beyond your control (e.g. natural disaster or major health crisis) prevents you from returning as planned, we’ll cover accommodation (same standard if possible) for up to 3 nights. This doesn’t apply to flights. The 3-night limit doesn’t apply to those with mobility issues, pregnant women, unaccompanied minors, or those needing medical help (if you told us at least 48 hours before the trip).
21.24 INSOLVENCY PROTECTION

21.25 PROMPT ASSISTANCE DURING YOUR EXPERIENCE
If you face serious issues while on your experience, we’ll help as quickly as possible. This includes support with health services, local authorities, embassies, communication, and finding travel alternatives. However, if the problem wasn’t caused by us or our partners, we’re not responsible for covering any costs. Airlines and transport providers might help, and you should claim directly from them. If you don’t contact us before making your own arrangements, we might not reimburse you. If the issue is caused by your actions, we may also charge a fee for helping you.
Afro Nation Boat Party – Terms and Conditions
22 General Information
These terms apply to all ticket holders (“You” or “Attendees”) attending an Afro Nation Portugal Boat Party (“Event”), operated by Afro Nation Portugal (“We,” “Us,” or “Organiser”).
By purchasing a ticket and/or boarding the boat, you agree to be bound by these Terms and Conditions and all other venue, local authority, and maritime safety rules applicable to the Event.
22.1 Ticketing and Entry
Boat Party tickets are sold as standalone or add-on events to Afro Nation Portugal tickets and are non-transferable and non-refundable, regardless of the reason for non-attendance.
Entry will only be permitted to guests who present a valid ticket. Attendees must arrive at least 30 minutes before departure. Late arrivals may be denied boarding and no refund will be issued.
All attendees must present a valid government-issued photo ID matching the ticket upon boarding.
22.2 Conduct & Behaviour
Attendees must behave responsibly and respectfully. Disorderly conduct, abusive behavior, or excessive intoxication may result in removal without refund.
No illegal substances, weapons, or prohibited items are allowed onboard. Any violations will be reported to the authorities.
Weapons, illegal substances, or dangerous items are strictly prohibited.
Attendees must comply with instructions from the crew and event staff at all times.
22.3 Health & Safety
Attendees participate at their own risk and are responsible for their personal belongings.
Individuals with medical conditions, pregnancy, or mobility issues should consult a physician and inform the crew upon boarding.
Life jackets and emergency equipment are available onboard; familiarise yourself with safety procedures and exits. In emergencies, attendees must immediately follow all crew instructions. The vessel is equipped with appropriate rescue and first aid equipment. Crew members are trained for emergencies and first aid. Attendees should notify the crew immediately if they are experiencing distress, injury, illness, or discomfort. Severely intoxicated or unwell attendees may be disembarked for safety purposes. Crew decisions in these matters are final. No outside alcohol is permitted on the boat.
22.4 Accessibility
Due to maritime safety, attendees must possess sufficient mobility for boarding, movement onboard, and disembarking independently or with personal assistance. The vessel may not be suitable for wheelchairs or significantly limited mobility. Please contact us in advance for accessibility queries. Accessibility restrictions are solely based on safety and operational considerations, not discriminatory intent. We aim to reasonably accommodate all attendees.
22.5 Event Cancellation or Changes
Events may be canceled or rescheduled due to adverse weather or other unforeseen circumstances. In the event of cancellation, refunds or rescheduling options will be provided as per our policy, but no liability is accepted for incidental losses.
22.6 Liability Waiver
By boarding the vessel, you acknowledge and agree: That boating activities carry inherent risks and you participate voluntarily. To release Afro Nation Portugal, event staff, and the boat operators from all liability for loss, injury, or damage sustained, except where caused by gross negligence. That you are physically and mentally fit to take part in the Event.
22.7 Media Release
The Event may be recorded or photographed. By attending, you give Afro Nation Portugal consent to use your image and likeness in promotional materials without compensation.
22.8 Governing Law
These terms shall be governed by and construed in accordance with the laws of Portugal, and any disputes shall be subject to the exclusive jurisdiction of the courts in that region.
Afro Nation Pool Party – Terms and Conditions
23. General Information
These terms apply to all ticket holders (“You” or “Attendees”) attending an Afro Nation Portugal Pool Party (“Event”), operated by Afro Nation Portugal (“We,” “Us,” or “Organiser”).
By purchasing a ticket and/or entering the venue, you agree to be bound by these Terms and Conditions, and to comply with all venue rules, local authority regulations, and safety instructions applicable to the Event.
23.1 Ticketing and Entry
Pool Party tickets are sold as standalone to Afro Nation Portugal tickets and are non-transferable and non-refundable, regardless of the reason for non-attendance.
Entry is only permitted to guests who present a valid ticket and government-issued photo ID. All attendees must be 18 years or older.
Guests must arrive on time. Late arrivals may be denied entry and no refunds will be issued under any circumstances.
23.2 Conduct & Behaviour
Attendees must follow all instructions from venue staff, security, and event personnel. Failure to comply may result in immediate removal without refund.
Any abusive, threatening, or unsafe behaviour - including excessive intoxication, disorderly conduct, or harassment will result in removal from the event and may lead to permanent exclusion from future Afro Nation events.
No illegal substances, weapons, or prohibited items are allowed on site. Violations will be reported to local authorities.
23.3 Health & Safety
Attendees participate at their own risk. Afro Nation Portugal is not liable for any personal injury, illness, loss, or damage unless caused by proven gross negligence.
The Event is held outdoors and may expose attendees to direct sunlight, water hazards, and crowded environments. Attendees are responsible for their own safety and personal belongings throughout the event.
Attendees with medical conditions, pregnancy, or mobility limitations should consult a physician prior to attending and inform event staff upon arrival.
By attending, you acknowledge inherent risks specific to pool-based and outdoor activities and voluntarily assume all such risks. You agree to release us from any liability for loss, injury, illness, or damage except where gross negligence is proven.
23.4 Alcohol Consumption
Alcohol may be served on site. Attendees are expected to drink responsibly.
Venue and bar staff reserve the right to refuse service or remove individuals who appear intoxicated or pose a risk to themselves or others.
No outside alcohol is permitted within the event grounds.
23.5 Event Changes or Cancellation
Pool Parties may be delayed, modified, or cancelled due to weather conditions, safety concerns, or circumstances beyond our control.
In the case of cancellation, Afro Nation Portugal will aim to reschedule the event but accepts no liability for incidental costs or losses. No refunds will be issued for delays or changes unless the event is cancelled in full and not rescheduled.
23.6 Liability Waiver
By entering the venue, you acknowledge and agree:
That attendance at pool-based and outdoor events carries inherent risks, and you voluntarily assume all such risks.
To release Afro Nation Portugal, its staff, and the venue operators from any liability for loss, injury, or damage, except where caused by proven gross negligence.
That you are physically and mentally fit to attend and participate in the Event.
23.7 Media Release
The Event may be photographed or filmed. By attending, you grant Afro Nation Portugal full rights to use your image, voice, or likeness in promotional or commercial content without compensation or further approval.
23.8 Governing Law
These terms shall be governed by and interpreted in accordance with the laws of Portugal. Any disputes shall fall under the exclusive jurisdiction of the Portuguese courts.
